    A recent Ontario Superior Court decision offers valuable insights into the importance of settlement offers made prior to trial. In this case, Hans Tan, a former depot manager, successfully sued his ex-employer, Storstac Inc., for wrongful dismissal. He was awarded seven months' termination pay. But, when both parties couldn’t agree on litigation costs, the court awarded Tan an additional $35,000, effectively doubling the financial liability for Storstac Inc. The reason for such a high cost award, was due to the fact that the Defendant had failed to accept a reasonable settlement offer made by the Plaintiff prior to trial. As a general rule, higher costs are awarded to plaintiffs who serve an offer to settle prior to trial, if the offer to settle is not accepted by the defendant and the award at trial is the same or higher than the plaintiff’s settlement offer.     The importance of future-proofing your employment contracts cannot be overstated. Failure to do so can leave your company exposed to increased liability and unforeseen termination costs.
