FAQ
What can I do if my spouse/partner takes the children with them?
The police cannot force a parent to return a child to another parent without a court order. While it is common for one party to at-least temporarily retain the children in a separation, it is important to quickly negotiate parenting time. If this cannot be done, you may be required to commence legal proceedings to ensure that your time with the children is protected. Acting promptly in this scenario is encouraged. We can assist you with negotiation or litigation in this circumstance.
How much child support should I pay or receive?
The amount of child support payable is governed the Child Support Guidelinesfor the Province of Ontario. Factors that determine child support are with whom and for what amount of time the children are residing, and the income of the payor parent. Book a consultation with us today and we can discuss your rights and responsibilities as they relate to child support.
Can my spouse make me leave our home?
In Ontario, if you are legally married, regardless of who owns the home on title, each spouse has a legal right to reside in the matrimonial home and cannot be forced to leave by the other spouse without a court order. To further discuss your rights to the matrimonial home, book a consultation with Loyens Law PC today.
